Your privacy is important to us. We at StimCardio Medical Inc., d/b/a StimCardio (the “Company”, “We”, “Us” or “Our”), a Delaware corporation, are committed to securing your personal data and your privacy. In connection with the Application, the Device and related clinical-trial activities, the Company works with its affiliate, Ziv Healthcare Ltd (“Ziv”). StimCardio Medical Inc. and Ziv Healthcare Ltd. jointly determine the purposes of processing of personal data collected through the Application in connection with the clinical trial and to the extent applicable under relevant privacy laws act as joint controllers in respect of such processing.
As long as the Device (as defined below) is not commercially available for sale and is in the clinical trial stage, linkage to a Device will only be done in the framework of clinical trials and in accordance with the terms and conditions applicable to such clinical trials. Although the Application may be downloadable, it is intended to be used only in connection with an approved clinical trial and with a compatible Device. This Privacy Policy is intended to provide you with clear and sufficient information regarding the information collected and processed in connection with your use of this StimCardio Application (the “Application”) and the StimCardio wearable technology currently being developed (the “Device”).
The information collected through the Application includes sensitive health and medical information. StimCardio and Ziv are committed to minimizing unnecessary exposure of participants' identities and to ensuring that access to and use of such information is limited strictly to what is required for the purposes described in this Privacy Policy and the Informed Consent Form.
Participation in the clinical trial is voluntary. You may refuse to participate or withdraw your consent at any time without penalty and without affecting your right to receive medical treatment or any other medical rights to which you are entitled. Refusal to participate or withdrawal from the trial will not prejudice your medical care in any way. Providing your personal information through the Application is also voluntary. However, because the Application is a required component of the app-based part of this clinical trial, if you choose not to provide the information requested through the Application, you will not be able to enroll in, or to continue participating in, that component of the trial.
If you do not agree to the terms and conditions set forth herein or if you are not a participant in the clinical trial sponsored by the Company or its affiliates, you are requested to cease using the Application.
The Informed Consent Form (ICF) that you have signed or will be asked to sign in order to participate in the clinical trial contains additional disclosures regarding your rights, data retention, the processing of your information, and the transfer of information to third parties. This Privacy Policy and the ICF should be read together; the ICF does not replace or supplement any disclosure that is required to be made in this Privacy Policy.
1. Information Collected and Processed via the Application (“Application Data”)
1.1. The username and password (the “Login Information”) that will be provided to you by a staff member of the clinical trial do not directly identify you.
1.2. You will be asked to respond to various questions, in connection with the clinical trial, including providing the details set out below:
- (a) Height
- (b) Weight
- (c) Medical History
- (d) Symptoms
- (e) Event Triggers
- (f) Age
- (g) Gender
- (h) Allergies
- (i) Medications
- (j) Immunization
- (k) Familial Medical history
1.3. When using the Device and Application, the following data is being collected and stored through the Application:
- A. Health related data:
- (a) ECG data collected from the device ECG measurements (Last X ECGs) – date and time and raw ECG data.
- (b) Data stored per each treatment (Last X treatments) - date and time, duration of treatment and average current.
- (c) Heart-rate data collected and transmitted by an optical sensor incorporated within the Device.
- B. Login and Usage Data: Login information, including the frequency of your logins into the Application and information about the way you use the Application.
1.4. Data Sharing. The information collected through the Application includes sensitive health and medical information and StimCardio and Ziv treat it accordingly. StimCardio and Ziv may access the information saved through the Application and any additional information collected through your participation in the clinical trial, and may share such information with the principal investigator, relevant trial personnel, affiliates, and service providers, but only: (a) in the circumstances described in this Privacy Policy and permitted by the ICF; (b) to the extent strictly necessary for the conduct of the clinical trial, the operation of the Application and the Device, the provision of related services, product and algorithm development as described in this Privacy Policy and permitted by the ICF, or compliance with applicable legal, regulatory, or ethical requirements; and (c) in a manner that minimizes unnecessary disclosure of your identity. All recipients of your information are required to maintain its confidentiality and to use it only for the purposes for which it was shared.

1.5. How We Use Application Data. StimCardio and Ziv may use Application Data to operate and support the Application, facilitate use of the Device in the context of the clinical trial, enable participant visibility into certain data, provide clinical-trial related services, maintain, develop and improve the Application and the Device, support product and algorithm development, including algorithm verification, use in the context of regulatory submissions and comply with applicable legal, regulatory and record-retention obligations, in each case to the extent described in this Privacy Policy and permitted by the ICF and applicable law.
2. Data Retention Policy, Managing Your Information
2.1. We retain the Application Data for as long as necessary to fulfil the purposes for which it was collected as set out in this Privacy Policy and the ICF, unless a longer retention period is required or permitted by applicable law, including for compliance with applicable legal, regulatory, ethical, reporting, or document retention requirements.

3. Information Security
3.1. We implement reasonable security measures appropriate to the sensitivity of the information processed through the Application.
3.2. We follow generally accepted industry standards to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of the Application and the Application Data. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect the Application Data, we cannot guarantee its absolute security.
3.3. We have physical, electronic, and procedural security measures and safeguards to reasonably protect the Application Data, including encryption of the data entered into the application. Our servers and our databases are protected by industry standard security technology, such as encryption, industry standard firewalls and password protection.
3.4. Please understand that you can help to keep your information secure by choosing and protecting your password appropriately, not sharing your password and preventing others from using your mobile device and/or the Application.
3.5. If you have reason to believe that the Application is no longer secure, please immediately notify a member of the clinical trial site staff.
4. Privacy Policy Updates
We may update this Privacy Policy from time to time, as we improve our current offerings, and as technologies and laws change. At the top of this page by looking at the “Last Updated” legend you can determine when this Privacy Policy was last revised. Any changes will take effect as soon as we upload the updated Privacy Policy. If these changes are significant, we will notify you by email, and where required by law, we will obtain your consent.
5. Your Rights
5.1. You have the right to request access to the personal information we hold about you, and the right to request that such information be corrected where it is inaccurate, incomplete, or outdated.
5.2. To exercise your rights of access or correction in relation to personal data processed in connection with the clinical trial, please contact your principal investigator or clinical trial site staff in the first instance, using the contact details provided to you as part of the clinical trial. If you have a general question about this Privacy Policy, you may also contact StimCardio Medical Inc., acting as the designated privacy contact point on behalf of itself and Ziv Healthcare Ltd., at the contact details set out in Section 6 below. Please do not include medical information, study results or other unnecessary sensitive or directly identifying information in your initial inquiry. Where appropriate, inquiries and requests may be redirected to, or handled in coordination with, the relevant study site, principal investigator, or authorized study personnel in order to protect participant confidentiality, verify the request, and facilitate an appropriate response.
5.3. Please note that these rights are subject to legal limitations and exceptions, including where retaining or restricting access to the information is required or permitted under applicable law.
